1. Who we are

ModNest ("we", "us", "our") is an independent project operated from the European Union. The best way to reach us for anything in these Terms - questions, take-downs, or account issues - is by email at [email protected].

2. What ModNest is

ModNest is a mod aggregator for games including Euro Truck Simulator 2, American Truck Simulator, and Farming Simulator. We index publicly available mod listings from third-party websites and present them in a single catalog. We do not host, store, or distribute the mod files themselves. Downloads and original posts are hosted by third parties, and when you follow a link you leave ModNest and are subject to that third party's terms.

We are not affiliated with, endorsed by, or sponsored by any game developer or publisher. Game names and trademarks belong to their respective owners.

3. Accounts

Some features require an account. You are responsible for keeping your credentials secure and for activity under your account. You must provide a valid email address and be old enough to enter a binding contract in your country. You may delete your account at any time from your account page.

4. Acceptable use

You agree not to: use the Service unlawfully; scrape, overload, or disrupt the Service or its infrastructure; attempt to bypass security, rate limits, or the ad gate; upload or link content that is illegal, malicious, or infringes others' rights; or misrepresent yourself. We may suspend or remove access for breach of these Terms.

5. Mod packs and user content

If you create mod packs or other content, you keep ownership of what you create, and you grant us a licence to host and display it on the Service so it works as intended. You are responsible for the content you post and confirm you have the right to post it. We may remove content that breaches these Terms.

6. Pro subscription and payments

ModNest offers an optional paid Pro subscription that removes the ad gate and unlocks additional features. ModNest is the seller of record for that subscription: you are buying from us, and we are responsible for the sale, for issuing your invoice and for accounting for any tax due on it. ModNest is operated from Sos. Bucium 55K, Iași, Romania, tax identification code 53833427. Card payments are handled by Stripe, our payment processor - Stripe processes your card details on our behalf and we never see or store them, but Stripe is not the seller and does not sell to you.

Price and tax. The price shown is the total amount you pay - there is nothing added at checkout. Where tax is due on your purchase it is included in that price and itemised on your invoice; where we are not required to charge it, no tax is added. If you are buying as a business you can enter your VAT or tax number at checkout so that it appears on your invoice. Your invoices are available at any time from your account, and the tax treatment applied to each payment is shown on them.

Renewal, cancellation and refunds. Subscriptions renew automatically at the then-current price until cancelled. You can cancel anytime from your account or the billing portal; access continues to the end of the period you have already paid for, after which the account returns to the free plan. We do not charge a cancellation fee.

All sales are final. ModNest Pro is digital content supplied immediately. We do not give refunds - not for part-used periods, not for a renewal you forgot to cancel, and not for a change of mind. Cancel before your next renewal date and you will not be charged again; the period you have already paid for runs to its end either way.

Immediate access and your withdrawal right. EU and UK consumers normally have 14 days to withdraw from a distance contract. Because ModNest Pro is digital content that starts working the moment you subscribe, when you subscribe you expressly ask us to begin supplying it immediately and acknowledge that you therefore lose that 14-day right of withdrawal. You confirm both at checkout. If you do not want to give up that right, do not subscribe.

Nothing here removes rights you have by law where they cannot be excluded - for example if we bill you in error, take a payment you did not authorise, or fail to supply the service. Those we will always put right.

7. Third-party content and take-downs

Because we index third-party listings, we do not control that content and do not guarantee its safety, legality, or accuracy. If you are a rights holder and believe a listing infringes your rights, email [email protected] with the listing URL and details of your claim, and we will review and, where appropriate, remove the listing.

8. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim warranties of any kind, including that the Service will be uninterrupted, error-free, or that indexed mods are safe to download. You download third-party files at your own risk.

9. Liability

To the extent permitted by law, we are not liable for indirect or consequential loss, or for damage caused by third-party mods or sites you reach through the Service. Nothing in these Terms limits liability that cannot be limited by law, including your statutory rights as an EU consumer.

10. Changes and termination

We may update these Terms; we will revise the date above and, for material changes, provide reasonable notice. Continued use after changes means you accept them. We may suspend or end the Service, or your access, where necessary (for example for legal, security, or operational reasons).

11. Governing law

These Terms are governed by the laws of Romania and applicable European Union law. Mandatory consumer-protection rules of your country of residence still apply. Disputes are subject to the competent courts of Romania, without prejudice to consumer rights.
